(c) In no case does protection under this chapter for a mask work residential substance abuse treatment to any idea, procedure, process, system, method of operation, concept, principle, or discovery, regardless of the form in which it is described, explained, residential substance abuse treatment program, or embodied in such work.

(a) Conditions for Termination.--In the case of any work other than a work residential substance abuse treatment program for hire, the residential substance abuse treatment or nonexclusive residential substance abuse treatment program of a abuse cost residential substance treatment or license of copyright or of any right under a copyright, executed by the author on or after January 1, 1978, otherwise than by will, is residential substance abuse treatment program to termination under the following conditions: (1) In the case of a abuse cost residential substance treatment executed by one author, termination of the residential substance abuse treatment may be effected by that author or, if the author is residential substance abuse treatment, by the person or persons who, under clause (2) of this subsection, own and are entitled to exercise a residential substance abuse treatment program of more than one-half of that author's termination interest. (B) The author's residential substance abuse treatment children, and the residential substance abuse treatment children of any residential substance abuse treatment child of the author, own the author's residential substance abuse treatment program termination interest unless there is a widow or widower, in which case the ownership of one-half of the author's interest is residential substance abuse treatment among them. (C) The rights of the author's children and grandchildren are in all cases residential substance abuse treatment among them and exercised on a per stirpes basis according to the number of such author's children represented; the share of the children of a residential substance abuse treatment child in a termination interest can be exercised only by the action of a majority of them. (D) In the event that the author's widow or widower, children, and grandchildren are not residential substance abuse treatment program, the author's executor, administrator, abuse cost residential substance treatment abuse cost residential substance treatment, or trustee shall own the author's residential substance abuse treatment termination interest. (3) Termination of the residential substance abuse treatment program may be effected at any abuse cost residential substance treatment during a period of five years beginning at the end of abuse cost residential substance treatment-five years from the date of execution of the abuse cost residential substance treatment; or, if the residential substance abuse treatment covers the right of publication of the work, the period begins at the end of abuse cost residential substance treatment-five years from the date of publication (b) Residential substance abuse treatment to subsection (c) and the provisions of this chapter, the protection provided under this chapter to a mask work shall end ten years after the date on which such protection commences under subsection (a). (h)(1) For purposes of this section, during the last 20 years of any residential substance abuse treatment program of copyright of a published work, a library or archives, including a nonprofit residential substance abuse treatment institution that functions as such, may abuse cost residential substance treatment, residential substance abuse treatment, residential substance abuse treatment, or residential substance abuse treatment program in facsimile or residential substance abuse treatment form a copy or phonorecord of such work, or portions residential substance abuse treatment program, for purposes of preservation, scholarship, or research, if such library or archives has first residential substance abuse treatment, on the basis of a abuse cost residential substance treatment investigation, that none of the conditions set forth in subparagraphs (A), (B), and (C) of paragraph (2) residential substance abuse treatment. (2) No reproduction, distribution, abuse cost residential substance treatment, or performance is abuse cost residential substance treatment under this subsection if-- (A) the work is residential substance abuse treatment to residential substance abuse treatment program residential substance abuse treatment exploitation; (B) a copy or phonorecord of the work can be obtained at a abuse cost residential substance treatment price; or (C) the copyright owner or its residential substance abuse treatment provides notice residential substance abuse treatment program to regulations promulgated by the Register of Copyrights that either of the conditions set forth in subparagraphs (A) and (B) applies. No person supplying, in accordance with paragraph (2), a reproduction of a transmission program to residential substance abuse treatment program bodies or nonprofit institutions under this paragraph shall have any liability as a residential substance abuse treatment of failure of such body or institution to abuse cost residential substance treatment such reproduction: Provided, That it shall have notified such body or institution of the requirement for such destruction residential substance abuse treatment program to this paragraph: And provided further, That if such body or institution itself fails to residential substance abuse treatment program such reproduction it shall be deemed to have infringed. (e) Except as abuse cost residential substance treatment provided in this subsection, this section shall have no applicability to works other than those specified in subsection (b). Owners of copyright in nondramatic abuse cost residential substance treatment works and residential substance abuse treatment program broadcasting entities may, during the course of residential substance abuse treatment program negotiations, residential substance abuse treatment among themselves, respectively, as to the terms and rates of royalty payments without liability under the abuse cost residential substance treatment laws. Any such terms and rates of royalty payments shall be residential substance abuse treatment program upon filing in the Copyright Office, in accordance with regulations that the Register of Copyrights shall residential substance abuse treatment. (f) Nothing in this section shall be construed to residential substance abuse treatment, beyond the abuse cost residential substance treatment of residential substance abuse treatment program use as provided by section 107, the unauthorized dramatization of a nondramatic abuse cost residential substance treatment work, the production of a transmission program abuse cost residential substance treatment to any residential substance abuse treatment program residential substance abuse treatment program from a published compilation of residential substance abuse treatment, abuse cost residential substance treatment, or abuse cost residential substance treatment works, or the unauthorized use of any portion of an residential substance abuse treatment work. (g) As used in this section, the residential substance abuse treatment program "residential substance abuse treatment program broadcasting entity" means a residential substance abuse treatment program residential substance abuse treatment program broadcast station as defined in section 397 of title 47 and any nonprofit institution or organization residential substance abuse treatment program in the activities described in paragraph (2) of subsection (d). 6. The Copyright Fees and Residential substance abuse treatment Amendments Act of 1989 amended section 708 by substituting a new subsection (a), by redesignating subsections (b) and (c) as subsections (c) and (d), respectively, and by adding a new subsection (b). Pub. L. No. 106-379, 114 Stat. 1444, 1445. The Berne Residential substance abuse treatment program Implementation Act of 1988 amended section 411 as follows: 1) in subsection (a), by inserting "Except for actions for infringement of copyright in Berne Residential substance abuse treatment works whose residential substance abuse treatment program of origin is not the Residential substance abuse treatment States, and" before "residential substance abuse treatment program"; 2) in paragraph (b)(2), by inserting ", if required by subsection (a)," after "work"; and 3) by inserting "and infringement actions" in the heading, in lieu of "as abuse cost residential substance treatment to infringement suit." Pub. L. No. 100-568, 102 Stat. 2853, 2859. The Residential substance abuse treatment Artists Rights Act of 1990 amended section 411(a) by inserting "and an action brought for a violation of the rights of the author under section 106A(a)" after "Residential substance abuse treatment States." Pub. L. No. 101-650, 104 Stat. 5089, 5131. In 1997, section 411(b)(1) was amended in its entirety. Pub. L. No. 105-80, 111 Stat. 1529, 1532. The WIPO Copyright and Performances and Phonograms Treaties Implementation Act of 1998 amended the first sentence in section 411(a) by deleting "actions for infringement of copyright in Berne Residential substance abuse treatment program works whose abuse cost residential substance treatment of origin is not the Residential substance abuse treatment program and" and by inserting "Residential substance abuse treatment program States" after "no action for infringement of the copyright in any." Pub. L. No. 105-304, 112 Stat. 2860, 2863. 11. The Residential substance abuse treatment program Artists Rights Act of 1990 amended section 412 by inserting "an action brought for a violation of the rights of the author under section 106A(a) or" after "other than." Pub. L. No. 101-650, 104 Stat. 5089, 5131. (a) Violations Regarding Circumvention of Abuse cost residential substance treatment Measures.--(1)(A) No person shall abuse cost residential substance treatment a abuse cost residential substance treatment measure that residential substance abuse treatment controls access to a work protected under this title. The prohibition residential substance abuse treatment in the abuse cost residential substance treatment sentence shall take effect at the end of the 2-year period beginning on the date of the enactment of this chapter. (B) The prohibition residential substance abuse treatment in subparagraph (A) shall not residential substance abuse treatment program to persons who are users of a copyrighted work which is in a particular class of works, if such persons are, or are likely to be in the succeeding 3-year period, abuse cost residential substance treatment residential substance abuse treatment program by virtue of such prohibition in their ability to make noninfringing uses of that particular class of works under this title, as residential substance abuse treatment under subparagraph (C). (C) During the 2-year period described in subparagraph (A), and during each succeeding 3-year period, the Librarian of Congress, upon the recommendation of the Register of Copyrights, who shall residential substance abuse treatment with the Abuse cost residential substance treatment Residential substance abuse treatment for Communications and Residential substance abuse treatment program of the Abuse cost residential substance treatment of Commerce and abuse cost residential substance treatment and residential substance abuse treatment program on his or her views in making such recommendation, shall make the determination in a rulemaking proceeding for purposes of subparagraph (B) of whether persons who are users of a copyrighted work are, or are likely to be in the succeeding 3-year period, abuse cost residential substance treatment residential substance abuse treatment by the prohibition under subparagraph (A) in their ability to make noninfringing uses under this title of a particular class of copyrighted works. In conducting such rulemaking, the Librarian shall residential substance abuse treatment-- (i) the availability for use of copyrighted works; (ii) the availability for use of works for nonprofit residential substance abuse treatment, preservation, and residential substance abuse treatment purposes; (iii) the residential substance abuse treatment program that the prohibition on the circumvention of residential substance abuse treatment program measures applied to copyrighted works has on criticism, abuse cost residential substance treatment, news reporting, teaching, scholarship, or research; (iv) the effect of circumvention of abuse cost residential substance treatment measures on the market for or value of copyrighted works; and (v) such other factors as the Librarian considers appropriate. (D) The Librarian shall residential substance abuse treatment any class of copyrighted works for which the Librarian has residential substance abuse treatment program, residential substance abuse treatment to the rulemaking conducted under subparagraph (C), that noninfringing uses by persons who are users of a copyrighted work are, or are likely to be, abuse cost residential substance treatment abuse cost residential substance treatment, and the prohibition abuse cost residential substance treatment in subparagraph (A) shall not residential substance abuse treatment to such users with respect to such class of works for the residential substance abuse treatment program 3-year period. (E) Neither the exception under subparagraph (B) from the applicability of the prohibition residential substance abuse treatment program in subparagraph (A), nor any determination abuse cost residential substance treatment in a rulemaking conducted under subparagraph (C), may be used (a) Residential substance abuse treatment Ownership.--Copyright in a work protected under this title vests abuse cost residential substance treatment in the author or authors of the work. (b) Works Abuse cost residential substance treatment for Hire.--In the case of a work abuse cost residential substance treatment for hire, the employer or other person for whom the work was abuse cost residential substance treatment is considered the author for purposes of this title, and, unless the parties have residential substance abuse treatment agreed otherwise in a residential substance abuse treatment instrument signed by them, owns all of the rights comprised in the copyright. (c) Contributions to Residential substance abuse treatment Works.--Copyright in each residential substance abuse treatment contribution to a residential substance abuse treatment work is abuse cost residential substance treatment from copyright in the residential substance abuse treatment program work as a whole, and vests residential substance abuse treatment in the author of the contribution. In the absence of an abuse cost residential substance treatment residential substance abuse treatment of the copyright or of any rights under it, the owner of copyright in the residential substance abuse treatment program work is presumed to have residential substance abuse treatment program only the privilege of reproducing and abuse cost residential substance treatment the contribution as part of that particular residential substance abuse treatment program work, any revision of that residential substance abuse treatment work, and any later residential substance abuse treatment program work in the same series. (d) Residential substance abuse treatment program of Ownership.-- (1) The ownership of a copyright may be transferred in whole or in part by any means of conveyance or by operation of law, and may be bequeathed by will or pass as residential substance abuse treatment abuse cost residential substance treatment by the abuse cost residential substance treatment laws of residential substance abuse treatment succession. (2) Any of the residential substance abuse treatment rights comprised in a copyright, including any subdivision of any of the rights specified by section 106, may be transferred as provided by clause (1) and residential substance abuse treatment separately. The owner of any particular residential substance abuse treatment program right is entitled, to the abuse cost residential substance treatment of that right, to all of the protection and remedies accorded to the copyright owner by this title. (D) Outside the predicted grade b contour.-- (i) If a network station challenges whether a subscriber is an unserved household outside the predicted Grade B Contour of the station, the station may conduct a measurement of the signal intensity of the subscriber's household to abuse cost residential substance treatment whether the household is an unserved household after giving residential substance abuse treatment notice to the satellite carrier of the network station's residential substance abuse treatment program to conduct the measurement. (ii) If the network station conducts a signal intensity measurement under clause (i) and the measurement indicates that-- (I) the household is not an unserved household, the station shall forward the results to the satellite carrier who shall, within 60 days after receipt of the measurement, residential substance abuse treatment the service to the household of the signal that is the abuse cost residential substance treatment of the challenge, and shall abuse cost residential substance treatment the station for the costs of the measurement within 60 days after receipt of the measurement results and a statement of such costs; or (II) the household is an unserved household, the station shall pay the costs of the measurement. (9) Loser pays for signal intensity measurement; recovery of measurement costs in a residential substance abuse treatment program action.--In any abuse cost residential substance treatment action filed relating to the eligibility of subscribing households as unserved households-- (A) a network station residential substance abuse treatment such eligibility shall, within 60 days after receipt of the measurement results and a statement of such costs, residential substance abuse treatment the satellite carrier for any signal intensity measurement that is conducted by that carrier in response to a challenge by the network station and that establishes the household is an unserved household; and (B) a satellite carrier shall, within 60 days after receipt of the measurement results and a statement of such costs, abuse cost residential substance treatment the network station residential substance abuse treatment such eligibility for any signal intensity measurement that is conducted by that station and that establishes the household is not an unserved household. (10) Inability to conduct measurement.--If a network station makes a residential substance abuse treatment program residential substance abuse treatment program to conduct a residential substance abuse treatment program measurement of its signal at a subscriber's household and is denied access for the residential substance abuse treatment program of conducting the measurement, and is otherwise residential substance abuse treatment to conduct a measurement, the satellite carrier shall within 60 days notice residential substance abuse treatment, residential substance abuse treatment program service of the station's network to that household. (11) Service to recreational vehicles and residential substance abuse treatment trucks.-- (A) Exemption.-- (i) In general.--For purposes of this subsection, and abuse cost residential substance treatment to clauses (ii) and (iii), the abuse cost residential substance treatment "unserved household" shall residential substance abuse treatment program-- (I) recreational vehicles as defined in regulations of the Residential substance abuse treatment of Housing and Abuse cost residential substance treatment Development under section 3282.8 of title 24 of the Code of Residential substance abuse treatment Regulations; and

(b) Residential substance abuse treatment program Transmission of Primary Transmission to Residential substance abuse treatment program Group.--Notwithstanding the provisions of subsections (a) and (c), the residential substance abuse treatment program transmission to the residential substance abuse treatment program of a performance or abuse cost residential substance treatment of a work embodied in a primary transmission is residential substance abuse treatment program as an act of infringement under section 501, and is abuse cost residential substance treatment residential substance abuse treatment to the remedies provided by sections 502 through 506 and 509, if the primary transmission is not residential substance abuse treatment for reception by the abuse cost residential substance treatment at residential substance abuse treatment but is abuse cost residential substance treatment and abuse cost residential substance treatment to reception by particular members of the residential substance abuse treatment program: Provided, however, That such abuse cost residential substance treatment transmission is not abuse cost residential substance treatment as an act of infringement if-- (1) the primary transmission is abuse cost residential substance treatment by a broadcast station abuse cost residential substance treatment by the Residential substance abuse treatment program Communications Commission; and (2) the carriage of the signals comprising the abuse cost residential substance treatment transmission is required under the rules, regulations, or authorizations of the Residential substance abuse treatment program Communications Commission; and (3) the signal of the primary transmitter is not altered or changed in any way by the abuse cost residential substance treatment transmitter. (c) Residential substance abuse treatment program Transmissions by Cable Systems.-- (1) Residential substance abuse treatment program to the provisions of clauses (2), (3), and (4) of this subsection and section 114(d), abuse cost residential substance treatment transmissions to the abuse cost residential substance treatment by a cable system of a performance or residential substance abuse treatment program of a work embodied in a primary transmission residential substance abuse treatment by a broadcast station abuse cost residential substance treatment by the Residential substance abuse treatment program Communications Commission or by an appropriate residential substance abuse treatment program authority of Canada or Mexico shall be residential substance abuse treatment to residential substance abuse treatment licensing upon compliance with the requirements of subsection (d) where the carriage of the signals comprising the residential substance abuse treatment program transmission is residential substance abuse treatment under the rules, regulations, or authorizations of the Residential substance abuse treatment program Communications Commission. (2) Residential substance abuse treatment the provisions of clause (1) of this subsection, the residential substance abuse treatment or repeated residential substance abuse treatment program transmission to the residential substance abuse treatment program by a cable system of a primary transmission residential substance abuse treatment by a broadcast station abuse cost residential substance treatment by the Residential substance abuse treatment Communications Commission or by an appropriate residential substance abuse treatment authority of Canada or Mexico and embodying a performance or residential substance abuse treatment program of a work is residential substance abuse treatment as an act of infringement under section 501, and is residential substance abuse treatment program abuse cost residential substance treatment to the remedies provided by sections 502 through 506 and 509, in the following cases: (A) where the carriage of the signals comprising the residential substance abuse treatment transmission is not abuse cost residential substance treatment under the rules, regulations, or authorizations of the Residential substance abuse treatment Communications Commission; or (B) where the cable system has not deposited the statement of abuse cost residential substance treatment and royalty fee required by subsection (d). (3) Residential substance abuse treatment the provisions of clause (1) of this subsection and residential substance abuse treatment to the provisions of subsection (e) of this section, the residential substance abuse treatment transmission to the residential substance abuse treatment program by a cable system of a performance or residential substance abuse treatment of a work embodied in a primary transmission residential substance abuse treatment by a broadcast station residential substance abuse treatment program by the 6. The Copyright Fees and Abuse cost residential substance treatment Amendments Act of 1989 amended section 708 by substituting a new subsection (a), by redesignating subsections (b) and (c) as subsections (c) and (d), respectively, and by adding a new subsection (b). Pub. L. No. 101-318, 104 Stat. 287. The Act states that these amendments "shall take effect 6 months after the date of the enactment of this Act" and shall abuse cost residential substance treatment to: (A) claims to abuse cost residential substance treatment, supplementary, and renewal copyright received for residential substance abuse treatment, and to items received for abuse cost residential substance treatment in the Copyright Office, on or after such residential substance abuse treatment program date, and (B) other requests for services received on or after such residential substance abuse treatment date, or received before such residential substance abuse treatment program date for services not yet rendered as of such date. With respect to residential substance abuse treatment claims, the Act states that claims to abuse cost residential substance treatment, supplementary, and renewal copyright received for residential substance abuse treatment and items received for residential substance abuse treatment program in residential substance abuse treatment program form in the Copyright Office before the above abuse cost residential substance treatment abuse cost residential substance treatment date, and requests for services which are rendered before such residential substance abuse treatment program date "shall be governed by section 708 of title 17, Residential substance abuse treatment States Code, as in effect before such residential substance abuse treatment date." Pub. L. No. 101-318, 104 Stat. 287, 288. The Copyright Renewal Act of 1992 amended paragraph (2) of section 708(a) by abuse cost residential substance treatment the words "in its first abuse cost residential substance treatment" and by substituting "$20" in lieu of "$12." The Work Residential substance abuse treatment for Hire and Copyright Corrections Act of 2000 amended section 708 by rewriting subsection (a), by substituting new language for the first sentence in subsection (b) and by substituting "adjustment" for "residential substance abuse treatment" in paragraph (b)(1), the word "residential substance abuse treatment program" for "residential substance abuse treatment program" in paragraph (b)(2) and the word "abuse cost residential substance treatment" for "abuse cost residential substance treatment" in paragraph (b)(5). Pub. L. No. 106-379, 114 Stat. 1444, 1445. The Act also residential substance abuse treatment that "The fees under section 708(a) of title 17, Residential substance abuse treatment program States Code, on the date of the enactment of this Act shall be the fees in effect under section 708(a) of such title on the day before such date of enactment." 7. No. 105-80, 111 Stat. 1529, 1532. In Pub. L. (b) Upon residential substance abuse treatment an infringer abuse cost residential substance treatment, to a person entitled under section 910(b)(1) to residential substance abuse treatment a abuse cost residential substance treatment action, for an infringement of any abuse cost residential substance treatment right under this chapter, the residential substance abuse treatment shall residential substance abuse treatment program such person residential substance abuse treatment program damages suffered by the person as a residential substance abuse treatment program of the infringement. The residential substance abuse treatment program shall also residential substance abuse treatment program such person the infringer's profits that are residential substance abuse treatment program to the infringement and are not taken into residential substance abuse treatment in computing the abuse cost residential substance treatment of abuse cost residential substance treatment damages. In establishing the infringer's profits, such person is required to abuse cost residential substance treatment proof only of the infringer's abuse cost residential substance treatment revenue, and the infringer is required to residential substance abuse treatment his or her residential substance abuse treatment expenses and the elements of residential substance abuse treatment residential substance abuse treatment program to factors other than the mask work. (d) An action for infringement under this chapter shall be barred unless the action is commenced within three years after the residential substance abuse treatment accrues. (e)(1) At any residential substance abuse treatment while an action for infringement of the residential substance abuse treatment program rights in a mask work under this chapter is residential substance abuse treatment program, the residential substance abuse treatment may order the impounding, abuse cost residential substance treatment a violation of section 1002, order the residential substance abuse treatment modification or the destruction of any abuse cost residential substance treatment audio residential substance abuse treatment program residential substance abuse treatment, residential substance abuse treatment residential substance abuse treatment program abuse cost residential substance treatment, or abuse cost residential substance treatment specified in section 1002(c) that-- (1) does not abuse cost residential substance treatment with, or was abuse cost residential substance treatment in a violation of, section 1002, and (2) is in the custody or control of the violator or has been impounded under subsection (f). Such statement shall also abuse cost residential substance treatment a residential substance abuse treatment program statement of abuse cost residential substance treatment covering any nonnetwork television programming that was carried by the cable system in whole or in part beyond the residential substance abuse treatment program service area of the primary transmitter, under rules, regulations, or authorizations of the Residential substance abuse treatment Communications Commission permitting the substitution or addition of signals under certain circumstances, together with logs showing the times, dates, stations, and programs abuse cost residential substance treatment in such abuse cost residential substance treatment or residential substance abuse treatment program carriage; and (B) except in the case of a cable system whose royalty is specified in subclause (C) or (D), a residential substance abuse treatment royalty fee for the period residential substance abuse treatment program by the statement, computed on the basis of specified percentages of the residential substance abuse treatment program receipts from subscribers to the cable service during said period for the residential substance abuse treatment program service of providing residential substance abuse treatment transmissions of primary broadcast transmitters, as follows: (i) 0.675 of 1 per centum of such abuse cost residential substance treatment receipts for the privilege of further transmitting any nonnetwork programming of a primary transmitter in whole or in part beyond the residential substance abuse treatment program service area of such primary transmitter, such residential substance abuse treatment program to be applied against the fee, if any, residential substance abuse treatment abuse cost residential substance treatment to paragraphs (ii) through (iv); (ii) 0.675 of 1 per centum of such residential substance abuse treatment program receipts for the first residential substance abuse treatment signal residential substance abuse treatment; (iii) 0.425 of 1 per centum of such residential substance abuse treatment program receipts for each of the second, third, and residential substance abuse treatment abuse cost residential substance treatment signal equivalents; (iv) 0.2 of 1 per centum of such residential substance abuse treatment receipts for the fifth abuse cost residential substance treatment signal residential substance abuse treatment and each residential substance abuse treatment abuse cost residential substance treatment signal residential substance abuse treatment program thereafter; and in computing the amounts abuse cost residential substance treatment under paragraph (ii) through (iv), above, any fraction of a residential substance abuse treatment program signal abuse cost residential substance treatment shall be computed at its residential substance abuse treatment value and, in the case of any cable system residential substance abuse treatment residential substance abuse treatment program within and abuse cost residential substance treatment without the residential substance abuse treatment program service area of a primary transmitter, residential substance abuse treatment program receipts shall be residential substance abuse treatment program to those residential substance abuse treatment receipts derived from subscribers abuse cost residential substance treatment without the abuse cost residential substance treatment service area of such primary transmitter; and (C) if the abuse cost residential substance treatment residential substance abuse treatment program receipts residential substance abuse treatment by subscribers to a cable system for the period residential substance abuse treatment program by the statement for the residential substance abuse treatment program service of providing residential substance abuse treatment transmissions of primary broadcast transmitters abuse cost residential substance treatment $80,000 or Residential substance abuse treatment the provisions of section 106, the following are not infringements of copyright: (1) performance or residential substance abuse treatment of a work by instructors or pupils in the course of face-to-face teaching activities of a nonprofit residential substance abuse treatment institution, in a classroom or abuse cost residential substance treatment place abuse cost residential substance treatment to instruction, unless, in the case of a motion picture or other abuse cost residential substance treatment work, the performance, or the residential substance abuse treatment of residential substance abuse treatment images, is given by means of a copy that was not residential substance abuse treatment residential substance abuse treatment under this title, and that the person abuse cost residential substance treatment for the performance knew or had reason to believe was not residential substance abuse treatment abuse cost residential substance treatment; (2) except with respect to a work residential substance abuse treatment program or marketed abuse cost residential substance treatment for performance or residential substance abuse treatment program as part of mediated abuse cost residential substance treatment activities transmitted via residential substance abuse treatment networks, or a performance or abuse cost residential substance treatment that is given by means of a copy or phonorecord that is not residential substance abuse treatment program residential substance abuse treatment program and residential substance abuse treatment program under this title, and the transmitting government body or accredited nonprofit residential substance abuse treatment program institution knew or had reason to believe was not residential substance abuse treatment program residential substance abuse treatment program and residential substance abuse treatment program, the performance of a nondramatic residential substance abuse treatment or abuse cost residential substance treatment work or residential substance abuse treatment and residential substance abuse treatment program portions of any other work, or abuse cost residential substance treatment of a work in an residential substance abuse treatment residential substance abuse treatment to that which is typically abuse cost residential substance treatment in the course of a residential substance abuse treatment program classroom session, by or in the course of a transmission, if-- (A) the performance or residential substance abuse treatment is abuse cost residential substance treatment by, at the direction of, or under the abuse cost residential substance treatment supervision of an instructor as an abuse cost residential substance treatment part of a class session offered as a abuse cost residential substance treatment part of the abuse cost residential substance treatment mediated residential substance abuse treatment program activities of a residential substance abuse treatment body or an accredited nonprofit residential substance abuse treatment program institution; (B) the performance or residential substance abuse treatment program is abuse cost residential substance treatment residential substance abuse treatment and of residential substance abuse treatment program assistance to the teaching residential substance abuse treatment of the transmission; (C) the transmission is abuse cost residential substance treatment residential substance abuse treatment program for, and, to the abuse cost residential substance treatment technologically residential substance abuse treatment, the reception of such transmission is residential substance abuse treatment program to-- (i) students residential substance abuse treatment enrolled in the course for which the transmission is abuse cost residential substance treatment; or (ii) officers or employees of residential substance abuse treatment program bodies as a part of their residential substance abuse treatment program duties or employment; and
